By accessing or using Smart Bid (the "Service") at smartbid.me, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Smart Bid is a real-time auction bidding tool designed for Australian property buyers. The Service provides budget zone management, bid tracking, stamp duty estimation, and financial impact calculations to assist users during property auctions.

Smart Bid is not a financial advisor, mortgage broker, or legal service. All calculations, estimates, and information provided by the Service are for informational purposes only and should not be relied upon as financial, legal, or property advice. Always consult qualified professionals before making financial decisions.

3. Accounts

You may create an account using your email address or Google sign-in. You are responsible for maintaining the security of your account and for all activities that occur under your account. Each account is intended for use by a single individual.

We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or used in violation of these terms.

4. Subscriptions & Payments

Day Pass

A Day Pass provides full access to the auction tactical display for 24 hours from the time of purchase. Day Passes are single-use and non-transferable.

Pro Subscription

The Pro subscription provides unlimited access to all features on a monthly billing cycle. Your subscription will automatically renew each month unless cancelled. You can cancel at any time through the subscription management page, and your access will continue until the end of the current billing period.

Payment Processing

All payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service. Prices are displayed in Australian Dollars (AUD) and may be subject to change with reasonable notice.

Refunds

If you are unsatisfied with the Service, please contact us at support@smartbid.me within 7 days of purchase. Refund requests will be assessed on a case-by-case basis.

5. Free Trial

Smart Bid offers a daily free trial of up to 10 minutes. The trial provides access to the full tactical display. Once the daily trial is used, you will need to purchase a Day Pass or Pro subscription to continue using the Service.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Use automated tools, bots, or scrapers to access the Service
• Resell, redistribute, or sublicense access to the Service
• Interfere with or disrupt the Service or its infrastructure
• Reverse-engineer, decompile, or attempt to extract the source code of the Service

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, user interface design, and software — are owned by Smart Bid and are protected by copyright and other intellectual property laws.

Your auction data and personal information remain your property. We claim no ownership over the data you enter into the Service.

8. Financial Disclaimer

Smart Bid provides stamp duty calculations, loan repayment estimates, deposit calculations, and other financial figures for informational purposes only. These are estimates based on general rates and formulas and may not reflect your actual obligations.

We strongly recommend consulting a qualified financial advisor, mortgage broker, or conveyancer before making property purchase decisions. First home buyer concessions, foreign buyer surcharges, and other special conditions are not accounted for in our calculations.

9. Limitation of Liability

To the maximum extent permitted by law, Smart Bid and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

We are not responsible for any financial decisions you make based on information provided by the Service, nor for any outcomes of property auctions you participate in.

10. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, if we reasonably believe you have violated these terms. Upon termination, your right to use the Service ceases immediately. Any remaining subscription period will not be refunded unless required by law.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Australia.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date on this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised terms.
